Terms & Conditions

Please read the following terms and conditions carefully before taking part in the cultural experiences:
 
1. Weather conditions:
a. Experiences are subject to weather conditions. Adverse conditions may affect the safety and viability of the experiences.
b. We reserve the right to cancel, postpone or modify scheduled experiences due to adverse weather conditions that may compromise the safety of participants and jeopardize the quality of the experiences. Adverse weather conditions may include: storms, strong winds, torrential rain, and dense fog, among others.
b. Both parties acknowledge that they have no control over bad weather.
c. Cancellations of experiences for the reasons mentioned above will be informed on the morning of the experience, via WhatsApp and email.
  
3. Rescheduling and Cancellation of the Activity:
a. In case of bad weather, the experience will have two attempts to reschedule, after the date initially scheduled. (Normally the following two days after the scheduled date). This rescheduling is subject to availability.
b. If the weather conditions remain adverse on the rescheduled day, the activity will be definitively canceled.
 
4. Reservation policy:
a. Reservations for the group experience must be made at least 48 HOURS in advance.
b. For private experiences, reservations must be made at least 72 HOURS in advance.
c. Booking PRIVATE experiences is subject to availability, and the dates requested for booking may not be available.
d. Booking PRIVATE experiences must be done exclusively via WhatsApp +351 911 935 453.
 
5. Food restrictions:
a. Participants' dietary restrictions are subject to the availability of food and products provided.
b. We strive to meet participants' dietary restrictions by offering lactose-free, gluten-free and vegetarian options. However, please note that we do not offer vegan options.
d. People with dietary restriction requests understand that these may not accommodate typical regional Azorean cuisine options.
e. Requests for dietary restrictions must be communicated as early as possible and at least 72 HOURS in advance, via WhatsApp +351 911 935 453, informing the date and time of the reservation and how many people subject to specific dietary requests.
f. Requests for dietary restrictions may be subject to an extra charge.
g. Any additional costs related to food restrictions must be paid on the same day as the request is made, by sending proof of payment to WhatsApp +351 911 935 453. It is important to note that requests for food restrictions will only be considered valid if requested and paid for within the required advance period.
 
6. Payment Policy:
a. Participants must pay the full amount of the activity to confirm their booking. Reservations not paid in full will not be considered valid.
b. Any additional costs related to dietary restrictions must be paid in advance. 
 
7. Starting times and meeting points for Group Experiences:
a. In spring and summer, the group experience starts at 17:30 PM.
b. In the fall and winter, the group experience starts at 3:30 PM.
c. Participants should arrive 10 minutes before the start time of the activity to avoid delays that could jeopardize the experience of other participants. 
d. The location and meeting point of the activity will only be informed via E-MAIL and/or WHATSAPP two days before the date of the experience.
e. Participants are responsible for knowing all the details regarding the times of the experiences, meeting point, duration, etc. By making a booking, participants confirm that they have read all the information available about the experiences, both via WEBSITE and via E-MAIL, as well as any sent by WHATSAPP. We cannot be held responsible for the misunderstanding or misinterpretation of any information provided to and by participants.
f. Times and meeting points may vary for private experiences.
 
8. Personalized requests in the Private Experience:
a. In the private experience, personalized requests or significant changes to the planned package or the experience offered will not be accepted.
b. In the private experience, requests and changes will only be accepted with regard to the timetable and specific food intolerances.
 
9. Refund and Cancellation Policy:
a. No cancellations or refunds are accepted, by the client, for any experience offered.
b. We reserve the right to cancel experiences whenever we consider that there are unsuitable conditions, such as adverse weather conditions, events and other circumstances that jeopardize the quality of the experience or the safety of the participants.
 
10. Risk acceptance:
a. Participants acknowledge that they are taking part in the experiments at their own risk.
b. Participants agree not to hold us responsible for events beyond our control including, but not limited to, adverse weather conditions.
 
11. Participant Responsibilities:
a. Participants are responsible for following the instructions provided by the guides and experience leaders.
b. Participants must act responsibly and take appropriate precautions throughout the experience.
 
14. Smoking:
a. Smoking is strictly prohibited during the experiences. This policy aims to ensure the safety and comfort of all participants.
 
15. Pets:
a. Except for duly identified and authorized guide dogs, pets are not allowed during the experiences. This restriction is applied to ensure the safety, hygiene and well-being of all participants.
 
16. Information:
a. While we do our utmost to ensure the accuracy of all information provided on our website, emails, or any other informational material, we cannot be held responsible for any misunderstandings or misinterpretations. 
b. This rewording maintains the essence of the clause, highlighting the importance of participants reviewing information and clarifying doubts, without explicitly mentioning what they can ask before taking part.
 
17. Participants with disabilities:
a. Access to the activity site is not suitable for wheelchairs. We do our utmost to ensure that disabled participants enjoy a similar experience to other participants, but we cannot take responsibility for any limitations that may arise due to a lack of accessibility.
b. For the participation of people with disabilities, we ask that you inform us at least 72 HOURS in advance, via WHATSAPP +351 911 935 453 of the booking date, time and number of people. This allows us to make the necessary arrangements, which are within our power only, to accommodate your needs in the best possible way during the experience.
 
By purchasing and participating in the experiences, all participants agree to accept all the terms and conditions set out above.

WAIVER AND RELEASE OF LIABILITY
 
I. Waiver of Liability for Inappropriate Behavior:
a. We are not responsible for any inappropriate behavior on the part of participants during the experiences. This includes children or adults who are destabilizing or hindering the performance of the experience.
b. In such cases, we reserve the right to ask these participants to withdraw from the activity to ensure that other participants can enjoy the experience without interference.
c. We do not assume responsibility for reimbursement or compensation due to inappropriate behavior on the part of participants.
 
II. Liability for Theft, Damage, Theft or Expenses:
a. We are not responsible for any expenses, theft, damage or robbery incurred during participation in the experiences. Participants are responsible for their personal belongings at all times.
b. Under no circumstances will we be liable for special, incidental, punitive, consequential or other indirect damages, even if we have been previously informed of the possibility of such damages.
 
III. Participation by Minors:
a. Although this activity does not present major risks of participation, the presence of minors under the age of 18 is only permitted with the express authorization of their parents or legal guardians.
b. Parents or legal guardians must send a document signed by them to the email address info@thingstodoinazores.com, authorizing the minor's participation in the experience.
c. Failure to provide written authorization will result in the minor being unable to take part in the cultural experience.
 
IV. Personal data for promotional purposes: 
Participants agree to permit us to use photos, videos, and recordings of their participation in the experiences. This includes the right to reproduce, display, distribute, and edit such material on our website and social media, publications, promotional and commercial materials. Participants acknowledge that we will be the exclusive owners of these materials and participants agree to grant a permanent, royalty-free, worldwide permission to use participants' names, ages, and hometowns in connection with these images and recordings. In addition, participants agree that all information related to them may also be used in catalogs, brochures, books, and magazines (physical and online) for informational, educational, advertising, or promotional purposes only. 
 
Participants acknowledge that by accepting these provisions, they waive significant rights (expressed above). 
By continuing to participate in the activities offered, participants voluntarily express their agreement to the terms of this waiver and release of liability. 
If a participant in the tours and tastings is not yet 18 years old, this indicates that a parent or legal guardian has also read and agreed to this waiver.
 
THIS IS A WAIVER AND RELEASE OF LIABILITY.

Website and Consumer Obligations
The user undertakes to:
i) Provide correct personal data and addresses;
ii) Not use false identities;
 
In the event that the consumer violates any of these obligations, we reserve the right to block their access to the site, cancel the provision of any other services made available simultaneously by us to the same User; and also not allow the User future access to any or all services made available by us.
It is expressly forbidden to use the products and services purchased for commercial purposes, namely for the purpose of reselling the experiences.
